Hi Francesco,
Just received the decision from the court, and unfortunatly they decided against you, and im sending you the decision in atach.
Beside we proved the acident, the damage, your losses, etc. the court said that the PT company owner of the cable made everything they can in that circustances and they couldnt had avoid the fallen of the cable. That is we lost the case because of the aplication of the legal rule that says that the owner of a thing wouldnt be punished if that thing causes any trouble to a third person if he can show that he has done all the things he could have to avoid the acident.
And they proved in court that they had a person passing several times a day in the area to check the cables and the wooden structure where the cable were hang on, so they took care well of the matter.
Now, We must decide if we are gonna appeal to a superior court wich have costs, of course, and im asking a friend of mine judge of a superior court to give his opinion on the decision.
As i said before we can take some time to decide cause the courts are closing on Monday so we wont be appealing before Setember.
